{"id":12134,"date":"2015-08-10T19:10:47","date_gmt":"2015-08-10T19:10:47","guid":{"rendered":"https:\/\/jljlawgroup.com\/?p=12134"},"modified":"2017-05-19T05:32:20","modified_gmt":"2017-05-19T05:32:20","slug":"do-foreign-nationals-enjoy-more-privileges-than-us-citizens-when-arrested-or-detained-by-police","status":"publish","type":"post","link":"https:\/\/jljlawgroup.com\/blog\/do-foreign-nationals-enjoy-more-privileges-than-us-citizens-when-arrested-or-detained-by-police\/","title":{"rendered":"Do foreign nationals enjoy more privileges than US citizens when arrested or detained by police?"},"content":{"rendered":"<div id=\"block-0ce69b7e47b01867b9fb\" class=\"sqs-block html-block sqs-block-html\" data-block-type=\"2\">\n<div id=\"yui_3_17_2_1_1454353592892_490\" class=\"sqs-block-content\">\n<p>Do foreign nationals enjoy more privileges than US citizens when arrested or detained by police?<\/p>\n<p id=\"yui_3_17_2_1_1454353592892_489\">The short answer is&#8230;well you determine. \u00a0Read on to see for yourself.<\/p>\n<\/div>\n<\/div>\n<div id=\"block-yui_3_17_2_8_1439242208716_11382\" class=\"sqs-block html-block sqs-block-html\" data-block-type=\"2\">\n<div class=\"sqs-block-content\">\n<p>When a foreign national, including an illegal alien or alien with a green card, is arrested or detained, he or she must be informed without delay of the right to have a consular officials from his or her country notified. \u00a0The foreign nationals must also have the right to communicate with those consular officials. \u00a0This notice and communication requirement must be given in addition to, not instead of, the Miranda warnings.<\/p>\n<p>In addition, when a foreign national is from a country that requires notification of an arrest or detention, the nearest consular officials must be notified without delay, regardless of the person&#8217;s wishes. \u00a0These countries include:<\/p>\n<p>Albania<br \/>\nAlgeria<br \/>\nAntigua and Barbuda<br \/>\nArmenia<br \/>\nAzerbaijan<br \/>\nBahamas<br \/>\nBarbados<br \/>\nBelarus<br \/>\nBelize<br \/>\nBrunei<br \/>\nBulgaria<br \/>\nChina (including Macao and<br \/>\nHong Kong)<br \/>\nCosta Rica<br \/>\nCyprus<br \/>\nCzech Republic<br \/>\nDominica<br \/>\nFiji<br \/>\nGambia<br \/>\nGeorgia<br \/>\nGhana<br \/>\nGrenada<br \/>\nGuyana<br \/>\nHungary<br \/>\nJamaica<br \/>\nKazakhstan<br \/>\nKiribati<br \/>\nKuwait<br \/>\nKyrgyzstan<br \/>\nMalaysia<br \/>\nMalta<br \/>\nMauritius<br \/>\nMoldova<br \/>\nMongolia<br \/>\nNigeria<br \/>\nPhilippines<br \/>\nPoland<br \/>\nRomania<br \/>\nRussia<br \/>\nSaint Kitts and Nevis<br \/>\nSaint Lucia<br \/>\nSaint Vincent and the<br \/>\nGrenadines<br \/>\nSeychelles<br \/>\nSierra Leone<br \/>\nSingapore<br \/>\nSlovakia<br \/>\nTajikistan<br \/>\nTanzania<br \/>\nTonga<br \/>\nTrinidad and Tobago<br \/>\nTunisia<br \/>\nTurkmenistan<br \/>\nTuvalu<br \/>\nUkraine<br \/>\nUnited Kingdom<br \/>\nUzbekistan<br \/>\nZambia<br \/>\nZimbabwe<\/p>\n<p>But, here is the caveat. \u00a0Although law enforcement officers should make every effort to comply with these procedures, failure to do so will not stymie the government from prosecuting the foreign national, even if the failure to notify would have helped his defense.<\/p>\n<p>Foreign nationals still have the same rights and protections as US citizens\u00a0(i.e. right to an attorney, right to remain silent, right of privacy, etc..) \u00a0They also enjoy the right to have their home country notified. \u00a0Their home country can help them locate an attorney who can fight for their rights and provide them with a defense. \u00a0But beware. \u00a0Despite the government&#8217;s requirement\u00a0to contact the foreign national&#8217;s\u00a0home country, \u00a0because there is no\u00a0penalty if notification fails to occur, foreign nationals are left with little added benefit over US citizens. \u00a0The requirement is an empty promise.<\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Do foreign nationals enjoy more privileges than US citizens when arrested or detained by police?
